Gas Safety — Landlord Obligations
The Gas Safety (Installation and Use) Regulations 1998 place a legal duty on landlords to ensure all gas appliances, fittings, flues, and pipework in their rented properties are safe and properly maintained.
Annual Gas Safety Check
You must arrange an annual gas safety check by a Gas Safe registered engineer for every gas appliance and flue in your rented property. This applies to boilers, gas fires, cookers, and any other gas-powered appliances provided as part of the tenancy. The check must be carried out every 12 months without exception — there is no grace period.
The Gas Safety Certificate (CP12)
Following the check, you will receive a Gas Safety Record (often called a CP12). You must:
- Keep a copy for at least two years
- Give a copy to your existing tenants within 28 days of the check
- Give a copy to new tenants before they move in
- Provide a copy to your local authority within 28 days if requested
Penalties for Non-Compliance
Failure to comply with the gas safety regulations is a criminal offence. The Health and Safety Executive (HSE) can prosecute landlords who do not carry out annual checks or provide tenants with the certificate. Penalties include unlimited fines and up to six months’ imprisonment. Beyond the legal consequences, an unsafe gas installation is a genuine risk to your tenants’ lives — carbon monoxide poisoning kills dozens of people in the UK each year.
Gas Safety and Possession Proceedings
If you have not provided your tenant with a valid gas safety certificate, you cannot serve a valid notice to recover possession under Section 8 of the Housing Act 1988. Compliance is therefore not just a safety obligation — it is a prerequisite for exercising your legal rights as a landlord.
Appliance Maintenance
In addition to the annual safety check, you must ensure all gas appliances are maintained in good working order. Most manufacturers recommend boilers are serviced annually — this is best done at the same time as the gas safety check to keep costs down and ensure continuous compliance. Keep maintenance records.
