Property Licensing in East London

If you own rental property in Redbridge, Newham, or Barking & Dagenham, you may be required to hold a licence under selective or additional licensing schemes. Operating without the required licence is a criminal offence and can result in significant fines and rent repayment orders.

Mandatory HMO Licensing

Across England, all Houses in Multiple Occupation with five or more people forming two or more separate households must be licensed under the mandatory HMO licensing scheme. This requirement applies regardless of borough. Mandatory HMO licences impose specific conditions relating to room sizes, fire safety, waste management, and property management standards.

Redbridge — Additional and Selective Licensing

Redbridge London Borough Council operates an Additional HMO Licensing scheme covering smaller HMOs (those with three or four occupants forming two or more households) across the borough. Landlords of properties that fall within this definition must apply for a licence through the council. Redbridge has also introduced selective licensing in designated areas of the borough — check the council’s website or contact us to confirm whether your property falls within a designated zone. Selective licensing applies to all privately rented properties in the designated area, not just HMOs.

Newham — Selective Licensing

Newham Council operates one of the most extensive selective licensing schemes in England, covering the entire borough. All privately rented properties in Newham require a selective licence. This scheme has been in place since 2013 and has been renewed and extended since then. Landlords must apply for a licence for each property and pay the applicable fee. Licence conditions include requirements for gas and electrical safety certificates, smoke alarm installation, and property management standards.

Barking & Dagenham — Selective Licensing

Barking & Dagenham Council operates borough-wide selective licensing. All privately rented properties — including single lets — require a licence. The scheme aims to address issues of poor property management, high concentrations of private renting, and the impact on local communities. Licence fees and application procedures are set by the council; contact the council’s Private Sector Housing team for current rates and application requirements.

Consequences of Operating Without a Licence

Failure to hold a required licence is a criminal offence. Penalties include:

  • An unlimited fine upon conviction in the Magistrates’ Court
  • A civil penalty of up to £30,000 imposed by the local authority (an alternative to prosecution)
  • A Rent Repayment Order (RRO) — tenants can apply to the First-tier Tribunal for repayment of up to 12 months’ rent paid during the unlicensed period. Local authorities can also apply for RROs.
  • Inability to serve a valid Section 8 notice in certain circumstances
